  • Condominium Law

    Our attorneys have handled the organization of many local condominium projects. After reviewing our clients’ plans for proposed condominium sites, we prepare applications to the South Dakota Real Estate Commission, and draft master deeds, covenants and declarations, lease agreements, purchase agreements, and other documentation to enable the condominiums to be leased or sold to the public.

  • Construction Law - Real Estate

    The firm can offer assistance during all stages of construction. We draft construction contracts. suggest modifications to the standard AIA and ACG forms, and assist with bidding and bonding. We offer help in filing and enforcing mechanic’s and materialman’s liens, and assist in removing improper liens from clients’ properties. Finally, our lawyers represent owners, architects, contractors, and suppliers in construction disputes in arbitration, mediation, and litigation.

  • Real Estate Transactions

    Our business attorneys represent clients in transactions affecting residential, commercial, agricultural and industrial properties. Title review, sales transactions, leasing, financing and closings are all services of our real estate experts.

    In the course of representing the buyer or seller in the completion of individual or corporate land sales, our lawyers draft purchase agreements, deeds, lead-based paint disclosures, property disclosures, and any other real estate document necessary for the completion of the transaction. We act as our client’s agent during real estate negotiations and attend the closing to ensure it goes smoothly.

    We also assist individuals and businesses with the complexities of commercial and residential leasing, by reviewing proposed leases to see that our clients’ interests are protected, or drafting leases to ensure our clients’ goals are met. In addition to overseeing the documentation we assist clients in every step of the lease formation process by attending conferences with our clients and other lessors, lessees, or their attorneys. At the other end of the spectrum, our attorneys are experienced in commencing and completing the eviction process when necessary.

  • Zoning and Land Use

    Our real estate lawyers assist both individuals and corporations with zoning land use issues related to their property. We draft the documents necessary to waive setbacks and to vacate streets. Our attorneys also represent clients at planning commission and city council hearings.
