Property tax rebate option for municipalities

A New Property Tax Rebate Option for South Dakota’s Cities
With the passage of House Bill 1260, South Dakota now allows municipalities to establish locally tailored property‑tax rebate programs for owner‑occupied single‑family homes. The law creates a new, optional mechanism cities can use to support their community goals.
A New Opportunity for Municipalities
HB 1260 gives municipalities a flexible new policy tool that did not previously exist in state law. Cities can now design rebate programs that directly advance their local objectives. Under the statute, only the municipal portion of the property tax is eligible for rebate, giving local governments full visibility and control over the fiscal impact.
The law also balances flexibility with fairness. While each municipality sets its own eligibility requirements through ordinance, it must issue a rebate to any applicant who meets those requirements. This ensures consistent administration while still allowing cities to customize program design to fit their community’s needs.
The Case for Local Flexibility
Rising housing costs across South Dakota have increased pressure on both residents and local governments, with multiple reports documenting significant year‑over‑year increases in statewide home prices. At the same time, economic analyses from the South Dakota Secretary of State show our communities face a growing need to attract and retain workforce talent, making housing availability and affordability increasingly important to local development.
Housing conditions also vary significantly between counties. Data shows large differences in median home prices, days on market, and inventory levels across major population centers and smaller communities alike. HB 1260 provides flexibility by allowing each municipality to design a rebate program that responds to its own population trends, housing stock, redevelopment priorities, or long‑term planning goals.
If a municipality enacts an ordinance, homeowners can expect clear eligibility criteria and predictable administration, since the statute requires rebates to be issued to anyone who qualifies.
